Reliance on any materials on this site is executed entirely at your own operational risk.
2. THIRD-PARTY INTELLECTUAL PROPERTY AND NOMINATIVE FAIR USE
EMB Design Tube is an independent digital marketplace. We possess no corporate affiliation, endorsement, authorized dealership, or sponsorship with Janome, Brother, Ricoma, Singer, Bernette, Pfaff, Husqvarna Viking, Bernina, or any other Original Equipment Manufacturer (OEM). All trademarks, service marks, and trade names remain the sole intellectual property of their respective corporate owners.
3. HARDWARE AND PRODUCTION LIABILITY LIMITATION
Under no circumstances shall EMB Design Tube, its directors, employees, or agents be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our digital files. This limitation of liability explicitly covers, but is not restricted to:
- Damage to OEM hardware (e.g., needle strikes, mechanical misalignment).
- Destruction or waste of raw materials and garments.
- Loss of commercial production time or operational downtime.
- Loss of revenue resulting from technical flaws or software incompatibilities within the design files.
4. END-USER VERIFICATION MANDATE
Users are strictly mandated to execute a complete test stitch-out using identical fabric and stabilizers prior to deploying any downloaded design file onto final commercial garments or production runs. The end-user bears the sole responsibility for verifying the integrity, tension, and operational safety of the design file before committing to final material execution.
5. EXTERNAL LINKS AND THIRD-PARTY ROUTING
Our platform may route users to external websites or third-party software resources (e.g., file decompression utilities). These entities operate outside our corporate infrastructure. We assume no liability for the content, data privacy protocols, or operational safety of these third-party platforms. System compromises or malware injections resulting from third-party software installations remain the sole responsibility of the user.
